Funds had been remitted to a trust run by him on the pretext of ring-fencing the money against possible future care Home, or Nursing Home charges. The overall total of such funds is thought to be in the region of £25M but he cannot recall where it is. The trouble is that the scheme


that was set up and publicised by long ought to be possible and legal, but unfortunately it simply is not. A weighty Government booklet called “charging for Residential Accommodation Guide” (“cRAG”) defines all the regulations about assets and disposals and it is very strict in its operation. For example a lady who is


entering a nursing home may legally give away her personal chattels - even, say, a £10K diamond ring, without fear that the gift may be challenged, but she cannot withdraw £10K from her building society with which to buy a diamond ring which is to be the subject of a gift. That gift would be void. According to cRAG your house is safe if your spouse continues to occupy it. These regulations are severe


and are operated by the relevant county council, who are the “safety net” for care home fees, when a resident runs out of funds, but because county council’s finances are very strictly curtailed they cannot be at all relaxed or casual about enforcing recovery. By comparison,

Inheritance Tax purposes, it is, of course, perfectly allowable to make gifts, which remain valid and unchallenged by HMRc and which have the effect of reducing your estate if you survive the gift by seven years. In fact HMRc have publicity guidance leaflets telling you how best to do this. But these principles are not mirrored in the case of care Home fees and local authorities. There is no such parallel for the seven year survival allowance. This does not mean that


gifts cannot be made. If your son or daughter is setting up in business, or is getting married, or has financial difficulties you certainly can make valid financial gifts. What matters is the purpose of the gift. Advice should be taken and careful, detailed notes be made recording

Marathon Challenge For Meningitis Saxmundham Sports


Suffolk Runner Takes On Twelve


MUlTIPlE marathon runner John Fensom will be running an incredible twelve marathons – all to raise money in memory of a family friend’s son who sadly died of meningitis. John, from Halesworth, decided to run the races in the space of a year after his childhood friend Bryan Hall and wife Georgie’s six-year- old ollie died from Meningitis B in october 2017. The marathons, which take place all over the country including Ipswich, Edinburgh, and Richmond, will culminate with the london Marathon in April. “After seeing the devastation


to Bryan and Georgie and his younger brother charlie by oliver’s tragically sudden death from meningitis I knew I wanted to do something,” John said. “I’ve never seen such loss and sadness.” Although John will be running to raise money for Meningitis Now in memory of ollie, he will also have his father in his heart on the day. “I’m grateful that my twelfth and final marathon of the


challenge will be at london 2019. It’s a special event for me not only because it was my first ever marathon but also because my father was dying of cancer at the time. “I had to make the hard decision to run it as I knew that’s what he wanted. luckily, I was able to get back to him to show him my finishers medal – but he died four days later. “london 2019 will not


only be a special end to the challenge, it’ll also be two years to the day since his passing. I’ll be running with both dad and oliver in my heart – it’ll be emotional, that’s for sure!”. John only started running seriously four years ago after going through what he called a “pretty bad mental and emotional breakdown”. He said he fell in love with the sport, finding it to be very meditative as well as a way to gain space for his thoughts. “It’s not that I stop thinking as I run,” he said, “but it helps untangle my thoughts and create space”.
