News Desk Oud elected to BIFA Board Who is

Susanne Oud (pictured) was elected to the Board of Directors at the BIFA AGM held on 22 May in London. She replaces Roy Baker who has stepped down. Susanne is operations director

EMEA-verticals at BIFA member company OIA Global, and is based at the company’s head office in London. Born in Perth, Australia, she

learned the trade through positions with an exporter, a shipping line and a freight forwarder, before establishing project forwarder and vessel agent Westlink Shipping. She emigrated from Australia to

the UK in 1998 and joined Bellville Rodair, which she helped to build

into an international company with 168 staff, and 21 offices on four

continents, before it was acquired by OIA Global in 2013.

A question we are asked from time to time is whether there is a danger to the incorporation of the BIFA STC when the customer uses a factoring company for invoice financing. The short answer is no. However, it is important that all staff are aware that

they should not waive the right to take a lien, which is something they can be asked to do by their customer on instructions from the factoring company. We know of a BIFA Member that was asked by one

of its customers to sign and return a ‘no lien waiver’ document drafted by a factoring company it was using. The proposed agreement was for the forwarder not to withhold delivery, that is not to exercise a lien. The customer stated that it had asked all its carriers to sign the document and others had already done so.

document. The factoring arrangement was under a contract

between the customer and the finance company and should not concern the freight forwarder, so the need for exercising a lien – always a last resort – should never arise, but there is no reason why the forwarder should waive that right. Our Member did comment that some carriers might

sign the form without understanding the implications and also not wanting to upset their customer. In the event that it does become necessary for the

forwarder to raise a lien, the article on pages 10-11 of this issue of BIFAlink gives guidance on ‘providing written notice to a customer concerning a lien’.
