In this complicated lawsuit (one of a multi- jurisdictional set of


lawsuits) involving the


alleged failure to redeem stock worth tens of millions of dollars, the trial court granted a preliminary injunction barring certain parties from any speech or conduct which “threatens litigation, or suggests or indicates intent to initiate litigation.” The simple issue on appeal is whether such an order is constitutional given the right to petition the government for a redress of grievances guaranteed un the First Amendment of the United States Constitution.

The appellant in this case filed a Petition for Judicial Review in the Circuit Court seeking review of a decision by the Prince George’s County Department of Environmental Resources that her car had been lawfully towed and impounded by a company regulated by the Department. The County ignored the petition, failing to filing anything in the trial court. The appellant moved for default judgment, but her motion was denied. Nevertheless, and despite the County’s lack of participation, no hearing was scheduled and the case was simply closed. This appeal followed.
