Introduction


This outline document has been prepared by East Anglia ONE Limited (EAOL) in response to a request from the Examining Authority at the Shipping and Navigation Issue Specific Hearing on 18th September 2013. This was a request for the applicant and Marine and Coastguard Agency to agree a method for post construction shipping surveys to validate the Navigation Risk Assessment (NRA) that is demonstrated thorugh a condition in the Deemed Marine License.


2 This is secured in the Deemed Marine License through Condition 14 (4) as follows;


(4) Construction monitoring shall include traffic monitoring in accordance with the outline navigation monitoring strategy, including the provision of reports on the results of that monitoring periodically as requested by the MCA.


2 3 Current UK policy and legislation


Current UK guidance in the form of Marine Guidance Notes (MGN) 371 - Offshore Renewable Energy Installations (OREIs) - Guidance on UK Navigational Practice, Safety and Emergency Response Issues states that:

‘Mitigation and safety measures will be applied to the OREI development appropriate to the level and type of risk determined during the Environmental Impact Assessment (EIA)...... and could include any or all of the following:


• Monitoring by radar • AIS • closed circuit television (CCTV) or • other agreed means.’


3 5 Agreed control mechanism


In consultation with the Martime and Coastguard Agency (MCA) East Anglia ONE Limited has agreed the following text to be incorporated into the Deemed Marine License;


(4) Construction monitoring shall include traffic monitoring in accordance with the outline navigation monitoring strategy, including the provision of reports on the results of that monitoring periodically as requested by the MCA.
