A balanced view


As always, there has been plenty in the news over the past two months relating to social care and the residential care sector. Sadly, many of the stories that appear in the main stream media relate to cases of poor practice, which are often shocking, but they can also serve as a reminder to everyone involved in the sector to continue to strive to improve and to achieve best practice. Of course, there is plenty that is good going on too. As a bi-monthly publication, the print version of TCHE only includes an overview news-wise of what has been happening. However, we aim to provide a balance of stories online to keep you up to date with the news day to day. By its very nature, the need to find a care home can come at a distressing time, with decisions being made in challenging circumstances. Recent market pressures mean that questions are being asked about whether consumers are being provided with value for money when choosing a care home or are falling victim to emotional pressures and as a result, entering into unfair contracts. Our legal update includes details of a study that is being undertaken by the Competition and Markets Authority (CMA), which will review how well the care home market works and whether consumers are being treated fairly.

The purpose of the study is to assess how people find the experience of choosing a care home, to explore whether the current regulation and complaints system gives residents adequate protection, and to examine how well care homes are complying with their obligations under consumer law. The results are likely to make interesting reading.
