NOTICE is hereby given that Devon County Council as Highway Authority for the County of Devon intends to apply to Torquay Magistrates’ Court sitting at The Court House, Union Street, Torquay, Devon TQ1 4BP on Monday the 10th day of April 2017 at 2.00 pm for an Order under Section 116 of the Highways Act 1980 authorising the stopping up of an area of the highway known as Kingswear Unclassified County Road No. H107 in the County of Devon shown hatched black between points A and B on the attached plan (Plan) (subject to the reservation of bridleway rights) on the ground that the said highway is unnecessary. The effect of the Order will be to extinguish all public rights of way over the said land (except for bridleway rights which shall be reserved and remain), save that any statutory undertaker whose apparatus is under, in, upon, along or across the highway the subject of this application will have the same powers and rights in respect of that apparatus as if the order authorising the highway to be stopped up or diverted had not been made or, as the case may be, as if the conveyance of land pursuant to Section 256 of the Act had not been made.
