TERMS & CONDITIONS


Ordering Procedure Orders may be placed by post, e-mail, fax or telephone. Whenever possible please use an order number and note our acceptance number. Telephone enquiries and orders are speeded up by quot- ing your account number. Any recommendations or suggestions relating to the use of the goods made by us is given in good faith but is for you to satisfy yourself as to the suitability of the goods for your purpose.


Carriage / Minimum Orders Accessories:


On the UK mainland all orders are carriage free. A service charge of £8.50 is made on all orders below £100 excl. VAT. We can post 1 pair of tiebacks for a charge of £3.00 or 2 pairs for £6.00. This applies only to a selection of tiebacks, please ask the sales office for more details.


Fabric & Custom Mades:


On the UK mainland carriage is charged at £8.50 on orders below £300 excl. VAT. Orders over £300 are carriage free.


Northern Ireland, The Isle of Man, Channel Isles & The Scottish Highlands & Islands carriage is charged at; £20 for a 3 day service on orders below £300 excl. VAT.


Southern Ireland; £25 for orders below £300.


Cancellations: Cancelled orders must be notified to our customer service depart- ment who will issue a cancellation reference number. Credit notes will not be issued without this reference number. We cannot cancel goods that have already shipped and will charge a re-stocking fee of 25% for refused deliveries, plus carriage costs.


Claims: Claims for Damage During Transit: Even though we endeavour to take extreme care to protect our goods in transit, it occasionally happens that goods are received damaged. Please can you en- sure that you count and check the condition of the goods prior to accepting the delivery. Any discrepancies must be acknowledged at the point of signature on the carrier’s delivery note and both our company and the carrier notified within 3 days of the delivery of the goods. No claim can be considered after this period.


Colour Matching: Whilst every effort is made to ensure that your order matches the sample an exact colour match cannot be guaranteed.


Custom Made Curtains: Work on orders for custom made curtains will only commence on receipt of written confirmation of the customer’s individual require- ments and will be manufactured under a no refund policy. Orders cancelled or changed after making up has started will be charged at list price. We accept no responsibility for curtains that do not fit due to the in-accuracy of the measurements given.


Cut Length: Please specify your curtain cuts when ordering cut lengths.


Design Repeats: Please allow for the possibility of variations of +/- 5%.


Fabric:


All fabrics must be checked for faults, pattern match or shortages before cutting. Faulty Goods (Fabric & Accs): Please check for faults before use. Faulty goods will be replaced, but our responsi- bility is limited to the value of the goods only. A reasonable oppor- tunity must be given for us to examine the goods before any claim can be considered. If any defects in the goods are found to exist we will replace those goods or the defective part, but we accept no liability for any consequential loss, damage or injury attributed to the use of such goods. We cannot be held responsible for labour or any other claim in respect of faulty material. We cannot be held responsible for, nor will we credit, any material that has been cut, treated, or made up. Faulty goods will only be accepted back with our prior consent.


Fading:


Our fabrics are produced to the highest standards. However, all fabrics can eventually fade. To reduce natural fading curtains


should be drawn back during daylight hours and upholstery fabrics should be kept out of direct sunlight.


Shrinkage:


All fabrics are liable to shrink and an allowance of 5% in making should be made. Shrinkage can be minimised by following the rec- ommended care instructions and all lined curtains should be dry cleaned.


Movement of Curtains in Situations: Atmospheric conditions can cause curtains to move when hung and we cannot be held responsible for abnormal conditions caus- ing movement. We recommend that a good allowance is made for alterations.


Next Day Service: All guaranteed next day UK deliveries are charged at £20. For next day pre-12 deliveries please request a price. For Northern Ireland, The Isle of Man, Channel Islands and The Scottish Highlands and Islands please ask for a price.


Non-Delivery / Delay in Delivery: The Company will use it’s best endeavours to promptly deliver goods ordered in accordance with the buyer’s reasonable require- ments notified to the Company at the time of ordering, but the com- pany shall be under no liability to the buyer for any non-delivery, part delivery or delay in delivery of the goods. Claims for Non-Deliv- ery: Must be made in writing within 7 days of receipt of invoice. The company will not be held liable for any failure to deliver or delay in delivery arising from circumstances beyond our direct control.


Prices:


All prices are those ruling at the date of acceptance of the order by the company and are net exclusive of VAT.


The company reserves the right at any time prior to delivery of the goods to adjust the prices without prior notice. The company can provide the cost of orders exclusive of VAT on request.


Payments: Credit Accounts: Credit accounts can be opened on receipt of sat- isfactory bank and two trade references in accordance with the company’s requirements but the company shall only supply goods under a credit account subject to such credit limit and other such requirements regarding the operation of such accounts as the com- pany may stipulate from time to time.


Proforma Accounts: You are to pay us in cash or in cleared funds prior to delivery un- less you have an approved credit account with us.


Credit Cards: All credit card payments will be subject to a 2% surcharge. Debit card payments will incur no extra costs.


Piece Goods: Pieces are approximately 30/50m in length (80/100m lining). Pieces are supplied to the nearest length above customer requirements. Specific lengths are charged at cut-length price.


Retention of Title: Whilst the risk in the goods shall pass to the customer on delivery, the ownership of the goods shall remain with us until ALL MONIES FOR ALL GOODS have been received by us.


Returns:


The company does not operate a sale or return policy on goods supplied in line with your orders. Only faulty or damaged goods can be returned and these must be in accordance with our prior written agreement. We reserve the right to impose a minimum 25% re-stocking charge on all un-solicited returns. If upon receipt & ex- amination of returned goods it is found that there is a discrepancy in the reason or quantities for the return we reserve the right to refuse the credit.


Samples: We reserve the right to charge for samples at cut-length price. Cus- tomers will be advised if cuttings or samples are to be chargeable.


Settlement Terms: Nett 30 days. We reserve the right to charge interest at 5% over NatWest base rate on overdue accounts.


Specification: We reserve the right to alter specifications without notice.
