Claims Litigation

When litigation occurs, it’s usually because the financial institution did not understand the details of the policy it purchased.

“In the case of an experienced buyer and an experienced broker buying from an informed company, those situations are really minimal.”

Christopher Taylor, Zurich

Litigation usually results from a misunderstanding of the terms and conditions of the OREO policy. The likelihood of litigation also increases when institutions, rather than managing their risk, look to insurance as the end strategy. Claims end up in litigation when a financial institution does fulfill its obligation for the care, custody and control of the property.
