the title insurance company hire lawyers and defend the lawsuit so long as there is “bare possibility of coverage.” There is no distinction between the duty to defend under a title-insurance policy and other liability policies. (Lambert v. Commonwealth Land Title Ins. Co. (1991) 53 Cal.3d 1072, 1077.) Furthermore, there only needs to be a single cause of action among all those that are present in the complaint for the title insurer to be obligated to defend the entire suit. The title insurer will have the duty to indemnify the insured by paying any settlement or judg- ment for the covered portions of the law- suit filed against the insured.

use of land or an easement, the client’s title-insurance policy may provide the client with both defense and any indemnity in that action. In the recent onslaught of cases where


a foreclosed home is bought at an auction or some other non-standard method, the disclosure of encumbrances on the proper- ty might be incomplete and title insurers have been known to miss liens on such properties that are covered under a title- insurance policy. Whenever an issue of title arises in your client’s affairs, it should be standard practice to obtain and review the title insurance policy, no matter how old it may be.
