It’s that time of the year again when we all make New Years Resolutions and try to stick to them for as long as possible. The usual resolutions are to “Get Fit”, “Lose Weight”, and “Start Saving.” Have you thought about starting the New Year by putting your legal affairs in order and entering into a Lasting Power of Attorney (LPA)?


There are two types of LPA, one for health and care decisions and one for financial decisions.


Both types of LPA allow you to choose who to appoint as your attorney(s) to make important decisions on your behalf.


A LPA for financial decisions enables your attorney(s) to deal with your finances (such as access your bank accounts, deal with your investments, pay your bills, sell or buy property). This can be used both while you retain capacity and should you ever lose your capacity in the future.


If you do not have a LPA for Finances and you


lose your capacity no body can deal with your finances. An application would have to be made to court to have somebody formally appointed. You would not have a choice over who is appointed and it could be that somebody other than a family member (such as social services) is appointed.


A LPA for health and care decisions enables your attorney(s) to make decisions about the type of health care and medical treatment you receive - including life sustaining treatment, where you live and day to day matters such as your diet and daily routine. Your attorney(s) can only make these decisions if you have lost your capacity.
