RESIDENT RELATIONS In Your Name Residents are responsible for utilities through the lease term, even if they vacate early. A


resident filed a complaint with HAA to receive a refund of her pet deposit and rent paid. The resident stated that she was told


if she moved out earlier than her move-out date she would be refunded for the days she was not in the apartment.


MANAGEMENT’S RESPONSE Management responded to HAA, stating


the resident visited the leasing office on March 31 to give her notice to vacate and that as she was filling out the notice to vacate form, she began to explain that she would have everything out of the apart- ment by May 15. She was told by management that since


her lease was not up until May 31, she did not have to turn in keys until then. The resident replied that she would have to turn in her keys early because she would no


longer be on this side of town. She was told that it would be fine to note the date when keys were turned in on her notice to vacate. It was explained to the resident also that


she would need to keep the electricity in her name until the lease’s end date and


condition form, resident’s notice of intent to move out and deposit disposition.


THE COMMITTEE’S DECISION The committee decided in favor of man- agement. The resident gave her 60-day notice

that she would be paying for water as well. The resident did not keep the electricity in her name, however. Management received a notice from the resident’s electric provider on May 19 stating that the power would be cut off on May 20. Management believed that the resident


was charged accordingly. Enclosed were copies of the lease, application, move-in


to vacate but did not fulfill her obligation. Charges were justified. The resident owes the property $37.16 and may wish to pursue this complaint in small claims court. If you are a manager with a resident rela-
