Terms and Conditions of Sale
Lindsay Phillips, LLC sells exclusively to the finest retail establishments, catalogs and dealers which promote Lindsay Phillips’ goals and objectives with regard to image, brand and customer service. We reserve the right to cancel any account for any reason.
1. OPENING ORDER: Our minimum initial order is $499.00 for any combination. All orders are subject to the approval of Lindsay Phillips LLC and the sales representative in the specified territory. All first orders must be paid by credit card or prepaid by check.
2. REORDERS The minimum reorder is $150.00.
3. ANNUAL PURCHASE REQUIREMENT A minimum annual purchase of $1500 is required to maintain an active customer status. If this level is not met, the account will be put on hold and require the same opening order requirements as stated above.
4. HOW TO PLACE AN ORDER Customers can place orders through local Onecoast Sales Representative or by calling 412-501-6042 or on the web at

5. PAYMENT & INVOICING We accept MasterCard, Visa, Discover and American Express. Invoices are emailed. Invoices paid with credit cards are billed at the time of shipment. Invoices for net accounts are payable in full within their approved terms. Neither orders nor backorders will be shipped to a customer until all past due balances are paid. No deductions are allowed without prior authorization from Lindsay Phillips, LLC.
6. TRANSSHIPPING
Lindsay Phillips, LLC will not tolerate any transshipping. We reserve the right to close any account reshipping Lindsay Phillips, LLC products to non-approved locations. All locations receiving Lindsay Phillips LLC product for resell must be identified when ordering.
7. ORDER CHANGES & CANCELLATIONS Order changes and cancellations must be submitted in writing and acknowledged by our account services team. We require order changes and cancellations be made at least 8 days prior to the ship date, otherwise we are unable to make changes to orders.
8. BACKORDERS Items not in stock will automatically be backordered and shipped as they become available, unless stipulated differently by the customer.
9. RETURNS All quality, short ship or damage claims must be submitted in writing on the Lindsay Phillips claim form and made within 14 days of the invoice date. If we request a return of merchandise, we will issue a Call Tag. We will process claims upon receipt of the complete claim and/or receipt of merchandise. Merchandise may not be returned without prior authorization. We reserve the right to refuse any unauthorized return. If an order is refused or returned without authorization, Lindsay Phillips, LLC will charge a 15% restocking fee as well as all applicable shipping costs. All products must be returned in saleable condition, in original packaging and free of marks and labels, otherwise an additional fee will be imposed.
10. SHIPPING & HANDLING All freight is paid for by the customer. Customers who choose to use their own collect account number must provide all information when submitting their order. FOB: NJ/NY/CA. Our standard method of shipping is via United Parcel Service (UPS) unless otherwise specified. All goods will be shipped ground. Regular delivery speed/shipping times vary by destination. www.ups.com for transit times. Shipping Restrictions (PO Box): We do not make deliveries to PO Boxes, in compliance with the policies of UPS, our standard shipping carrier. We reserve the right to change our standard carrier at any time.
11. CONSUMER RETURNS & EXCHANGES All product bought by a consumer in a retail store must be returned or exchanged at that store according to their policy. We will make exceptions for product bought overseas or for major product recalls. Only the retail store should contact Lindsay Phillips, LLC directly regarding returns or exchanges.
12. PRICING/MSRP
All wholesale and retail prices listed in this book are in US Dollars. Wholesale prices may change without notice. Lindsay Phillips, LLC requires that all resellers doing business with Lindsay Phillips LLC adhere to our stated MSRP (Manufacturer's Suggested Retail Price). This dictates that the account holder must price all products being advertised in either stores or on websites according to a minimum price set at a predetermined amount by Lindsay Phillips, LLC. The purpose behind this policy is to prevent unfair business practices among Lindsay Phillips, LLC dealers. Lindsay Phillips LLC, reserves the right to terminate an account if, in the sole judgment of Lindsay Phillips LLC, an account is in violation of this policy.
