LIMITED WARRANTY: Hamilton Sorter Co., Inc. (“Hamilton Sorter”) warrants to the original retail purchaser that Hamilton Sorter MailCenter products (the “Hamilton Sorter Products”) purchased on or after January 1, 1996 will be free from defects in material and workmanship for as long as the original retail purchaser owns such Hamilton Sorter Product, except for the following Hamilton Sorter Products which are warrented for three years from the date of purchase as shown on the purchaser’s receipt: Tackboard fabric, task lights, casters, bag racks, carts, adjustable keyboards and module shelf standard as well as any powdercoated item. This warranty is made solely to the original retail purchaser and shall be effective from the date of purchase as shown on the purchaser’s receipt. This warranty is void for any damages to the Hamilton Sorter Product due to misuse, abuse, neglect, accident, improper installation, failure to comply with instructions furnished by Hamilton Sorter or any repair or alteration performed by anyone other than Hamilton Sorter or an authorized Hamilton Sorter dealer. Damage caused by common carrier during shipment is not included in this warranty. THIS WARRANTY IS THE ONLY WARRANTY MADE BY HAMILTON SORTER, AND ALL OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRAN- TIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED.
During this warranty period, if any Hamilton Sorter Products sold, which are subject to this warranty, prove to be defective in material and/or workmanship under normal use, within the warranty period set forth above, the purchaser must contact an authorized Hamilton Sorter dealer or Hamilton Sorter in writing or by telephone to arrange for inspection of such Hamilton Sorter Product by an authorized representative. The Hamilton Sorter representative after inspection will issue a return autho- rization for such Hamilton Sorter Product. No Hamilton Sorter Product will be accepted for return unless prior authorization is obtained from Hamilton Sorter. Hamilton Sorter shall, at its option either (1) repair such Hamilton Sorter Product free of charge or (2) replace such Hamilton Sorter Product free of charge. Hamilton Sorter will pay all shipping charges associated with the authorized return, repair and or replacement of a defective Hamilton Sorter Product. THIS IS THE EXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY. IN NO EVENT SHALL HAMILTON SORTER BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER FOR BREACH OF ANY WARRANTY, FOR BREACH OF REPUDIATION OF ANY OTHER TERM OR CONDITION OF SALE, FOR NEGLIGENCE, ON THE BASIS OF STRICT LIABILITY, OR OTHERWISE.
