CITY OF AVONDALE FOR APPROXIMATELY 19.44 ACRES GENERALLY LOCATED AT THE SOUTHWEST CORNER OF LOWER BUCKEYE ROAD AND AVONDALE BOULEVARD, AS SHOWN IN FILENAME PL- 11-0199, REVERTING
ZONING ON SUCH PROPERTY FROM PLANNED AREA DEVELOPMENT (PAD)
AGRICULTURAL (AG). WHEREAS, the Council of the City of Avondale (the “City Council”) approved Ordinance No. 1999-906 on September 5, 2006, rezoning that certain + 67 acre parcel of land generally located at the southwest corner of Lower Buckeye Road and Avondale Boulevard, as more particularly described and depicted in Ordinance No. 1999- 906, (the “Original Property”), from Agricultural (AG) to Planned Area Development (PAD) and imposing conditions upon such rezoning (the “Rezoning”); and WHEREAS, the Rezoning
was subject to a condition imposed pursuant to provisions of the City of Avondale Zoning Ordinance (the
Ordinance”), requiring that the development of the fi rst phase of the residential and commercial projects on the Original Property must have commenced within three years of the effective date of the ordinance approving the PAD zoning on the property (the “Time Condition”); and WHEREAS, the
Condition upon the Rezoning has not been met with respect to the + 19.44 acre commercial portion of the Original Property (Lot 1, Fleming Farms, Book 989, Page 41, Maricopa County Records, otherwise referred to herein as the “Subject Property”) and the City Council desires to revert the zoning on the Subject Property from Planned Area Development (PAD) to Agricultural (AG); and WHEREAS, the City Council desires to amend the City of Avondale Zoning Atlas (the “Zoning Atlas”) pursuant to Ariz. Rev. Stat. § 9-462.04 to refl ect the change in zoning on the Subject Property due to the Rezoning reversion; and WHEREAS, all due and proper notice of the public hearing on the intended Rezoning reversion and Zoning Atlas amendment held before the City Council were given in the time, form, substance and manner provided by the Zoning Ordinance; and WHEREAS, the City Council held a public hearing regarding the Rezoning reversion and amendment to the Zoning Atlas on April 2, 2012. NOW, THEREFORE, BE IT

Department of Housing and Urban Development (HUD) is expected to allocate approximately $603,568 in Community Development Block Grant (CDBG) funds and $140,952 in HOME funds to the City of Avondale for fi scal year 2012/2013 which begins on July 1, 2012 and extends through June 30, 2013. To be eligible to receive the funds the City of Avondale must submit the 2012/13 Annual Action Plan which serves as an update their 5-year 2010-2014 Consolidated Plan. The Consolidated Plan identifi ed the housing and community development needs of low-income and special needs persons and prescribed strategies to address those needs. The Annual Action Plan describes which activities will be undertaken during the upcoming fi scal year using CDBG and HOME funds. The City of Avondale is currently seeking comments for the plan from Avondale residents, service providers, businesses and governments.
The City Council will hold a public hearing, review and may take fi nal action to approve the 2012/2013 Annual Action Plan at 7:00 P.M. on Monday, April 16, 2012 during the Regular City Council Meeting. The meeting will be held in the City Council Chambers, 11465 W. Civic Center Drive, Avondale, AZ 85323.
