decision The Environmental Protection Agency is


studying a U.S. District Court ruling that up- holds North Dakota’s haze pollution policy for two power plants. “At this point, the EPA is reviewing the court decision and we will continue to work with state offi cials to protect the health and environment,” EPA spokesman Richard Mylott said Dec. 23. Mylott is a spokesman for the federal agency in its Denver regional offi ce. He gave no further response when asked if


the EPA planned to appeal U.S. District Judge Daniel Hovland’s 34-page ruling, which was re- leased Dec. 22. In his ruling, Hovland said that to throw out


the state’s policy, the EPA must prove the North Dakota Department of Health’s proposal is in- adequate. “The court fi nds the EPA has not met that burden,” Hovland said. The state wants the federal agency to adopt


a state health department proposal that would require Minnkota Power Cooperative Inc. to install $400 million in pollution controls. The EPA wants a more sophisticated and more cost- ly method of treating the exhaust. Minnkota, which owns the Milton R. Young plant near Center, fi led the motion in federal court to re- solve the dispute. Hovland said the state’s fi ndings about pollu-


tion control technology were not unreasonable. The Leland Olds plant was built by Basin


Electric in 1966. Its $410 million project to add sulfur dioxide scrubbers for each of the plant’s two units is almost complete.

fall was trying to help DICKINSON (AP) — Authorities said a 39-


year-old man who died earlier this week when a trench caved in at a Dickinson home construc- tion site was trying to save another worker. A representative from the Occupational


Safety and Health Administration said that Cas- simiro Medina was one of several workers who came to help a man after an initial collapse. Medina, of Salt Lake City, died from injuries


after he was buried from a second collapse. Police said two other men were treated for their injuries and released.


Australian coal co. names


Wyo. lawmaker to board GILLETTE, Wyo. (AP) — A Wyoming state


lawmaker has become a director of an Austra- lian coal company that wants to mine Powder River Basin coal. Republican Rep. David Miller of Riverton sold his Campbell County mineral rights to Sydney-based County Coal Ltd. for $200,000 on March 11. Miller, a geologist, became a director


of the company on April 29. He now holds 1 million shares in the com-


pany and will get 3 percent royalty payments on coal mined in the basin, one of the richest coal sources in the United States. “They asked me if I would be a director of the


company,” Miller said. “I said, ‘I think I can.’” Miller said he will recuse himself from any


votes in the Legislature that directly affect Coun- ty Coal projects, but he said votes on coal issues in general aren’t as clear cut. County Coal didn’t respond to a request for


more information about its Powder River Basin plans. If it can secure permits and extract coal, the


company has said it plans to ship the coal to Asia.


N.D. construction fi rm wins


marina project lawsuit DICKINSON (AP) — A federal judge has


sided with a Dickinson-based construction fi rm that sued to recover more than $3 million from the U.S. Army Corps of Engineers for work on the Fort Stevenson State Park marina. Judge Thomas Wheeler ruled in favor of


Martin Construction Inc. on Dec. 20. The corps fi red Martin Construction and


terminated its $7 million contract, saying the project was behind schedule. Judge Wheeler said the corps made a mistake


in the project’s design and blamed the contrac- tor.


The lawsuit fi led in the U.S. Court of Fed-


eral Claims seeks payment to cover Martin Con- struction’s expenses from the project. The corps did not have an immediate com- ment on the lawsuit.


EPA moves on ozone regs


in western Wyo., elsewhere CHEYENNE, Wyo. (AP) — The U.S. Envi-


ronmental Protection Agency is moving ahead with a proposed regulatory designation that could increase pressure on the gas industry to limit emissions that have led to severe winter- time ozone pollution in western Wyoming. The EPA is doing so while it settles a nation-


wide lawsuit over ozone fi led by an environmen- tal group, WildEarth Guardians. In 2009, Wyoming Gov. Dave Freudenthal


recommended that the EPA enact what’s known as “nonattainment status” for ozone in the Up- per Green River Basin. The EPA has informed Gov. Matt Mead it is now prepared to support that recommendation. The EPA’s slow response on ozone nonat- tainment in mainly urban areas prompted WildEarth Guardians to sue in August. Mead said he’s pleased the EPA has agreed


with the state’s recommendations for ozone nonattainment.
