Business who owns your FAMILY HOME? by Mary Shaw Y
ou may have read in the newspapers about the Supreme Court’s Decision in the case of Jones v Kernott. Ms
Jones and Mr Kernott bought a property in 1985 in their joint names. Ms Jones provided the deposit money. In 1993 Mr Kernott moved out and in 2006 he brought a case in the Court for a share in the value of the property. The Court of Appeal decided that Mr Kernott was entitled to a half share in the property. However the Supreme Court decided that Mr Kernott would only receive the amount that he would have received in 1995 when the couple had defi nitely split up and Mr Kernott had bought his own home. The Court therefore gave him 10% of the value of the property rather than the 50% that he was claiming.
Of course each case is different and if the Court is asked to decide how much each party should take
It is therefore much more sensible for couples buying
property together to have their ar rangements written down in a legal document
after the sale of the property then the Judges will take into account the individual circumstances of the couple and the family, but it costs a great deal of money to ask the court to make these decisions.
It is therefore much more sensible for couples buying
property together to have their arrangements written down in a legal document so that if they do split up then they know where they stand. Also, it is very important that if couples do split up owning property then they reach an agreement at the time that they separate so that everybody knows exactly where they stand and they do not have to spend the time and money asking the Court to make decisions for them.
If you are thinking of buying a property with your partner or if you already own a property jointly and you would like an Agreement drawn up setting out exactly how the proceeds of sale should be divided between you in the future, then please contact Mary Shaw at

Government announces £1bn youth employment initiative
The Government has announced a £1 billion initiative that should provide hope for the million young people who are currently out of work. Nick Clegg announced his youth contract scheme, which will give
employers subsidies worth £2,275 to take
on 160,000 18 to 24 year olds over a three- year period. Carmen Watson, Managing Director of Pertemps Recruitment Partnership, said, ‘this contract model will go a long way in providing sustainable employment that the UK jobs market desperately needs. Far too often have we seen measures that fail to have a long-term effect because they don’t go deep enough in tackling the root problems of long- term youth unemployment.
‘Providing subsidies to private sector employers will directly engage businesses and encourage them to act in confi dence, take on new young workers, and at the same time secure the future of their own companies. This scheme is a much needed effort to tackle joblessness among young people but it should only been seen as one step in the journey towards reaching this goal. However, a much more far-reaching initiative is required to dramatically reduce what is an incredibly worrying situation.’
It’s a new da wn; it’s a new da y... let’s be positiv e out there…by John Hayes Chamber Marketing Director
When you think about how quick news travels and how the world is getting smaller and smaller with the power of the internet, we at the Chamber have been thinking about the disastrous, economic outlook we have all seen with our own eyes via the mass media and the incredible speed that information moves via the Internet and in the main it’s all doom and gloom! So, we decided to do a bit of research and see
what good news there is out there and spread the word of positivity! Here is my positive news for this coming winter and into 2012:- IQ scores are rising all around the world. A modern car emits 95 per cent less carbon

monoxide, nitrogen oxides and hydrocarbons than it did in the Seventies.
Inequality is falling as poor countries such as India, Brazil and Botswana get rich faster than rich countries such as Britain, America and Japan. So let’s put some other things in perspective with regard to the economy, because if you own a business, that is probably the most pressing issue on a weekday morning! Today’s businesses are in pretty good shape. They are embracing the fact that good marketing is paramount to their business and the internet is the key to that growth. Emerging markets are also thriving with
economises such as Brazil, India and China growing at 6% annually and buying goods and services from the West. They are buying weapons’, pharmaceuticals, hi-tech electrical goods and services such as architectural knowledge, accountancy and logistical know-how! I have always been of the opinion that it is not Governments that improve the economy, stimulate growth, innovate and
invent....It’s us that does that! The people of this great nation!
At the South East London Chamber of Commerce we are constantly helping businesses grow, can we help you?
