Opening the door onmanaging risk
The UK door industry continues to respond to existing and impending legislation on fire rated doors and the subject is coming under closer scrutiny. The Regulatory Reform (Fire Safety) Order 2005 (RRO) was implemented in October 2006 - transferring responsibility for fire safety from the fire authorities to whoever has day-to-day control of the premises. In essence, this person must be responsible for fire safety and arrange for a documented ‘risk assessment’ to be carried out. The assessment process includes regular inspection of fire doors, associated glazing and screens, and any impairment must be immediately addressed. The European Parliament ratified the Construction Products Regulations in January 2011 so it will become mandatory for fire and escape route ‘doorsets’ to be CEMarked from July 2013. Doorsets are increasingly becoming the preferred choice for many contractors with the benefits of removing trades from site to environmentally and quality controlled environments. CEMarked doorsets move the liability from multiple sources to single legal identities. All of this legislation places the building owner and the person of named responsibility directly on the line. Five years have passed since the implementation of RRO and individuals have been imprisoned and heavily fined. The person of named responsibility is personally liable and cannot hide behind the veil of incorporation. Perhaps we need to be more sceptical of ‘low price’ solutions using materials which in the long term may prove to be not fit for the purpose.
