Marathon Oil and EOG Resources have such systems in place. Continental Resources is another company that uses a semi-closed system on some wells.


The regulation process The proposed regulations will go through a public comment period and then lengthy review from the state. Public comment opened with a hearing on Nov. 1 and with written comments submitted until Nov. 14. Then, the Industrial Commission will review public comments and decide if changes need to be made to the proposed rules.


As it stands, the proposed rules would be finalized and in effect by April 1, 2012.


The changes come at time when drilling continues to thrive. State records obtained by the Bismarck Tribune show that nearly 2,000 new


proposed changes to how North Dakota’s oil industry can do business, it might have seemed like a bit of déjà vu for Hanson. The 60- year-old Souris resident serves as president for the Northwest Landowners Association, a group that represents landowners in the northwest area of North Dakota, particularly those who are concerned about the long-term impact of the fast-paced footprint of big oil in the Bakken formation.


Hanson maintains that he supports the state oil industry and that he isn’t “anti-oil.” He would still rather see a closed-loop system disposal system introduced, but said a semi- closed system is at the least a step in the right direction.


“I have seen this my whole life. I have a well on my dad’s land that was drilled in 1958 and the conversation is the same as it was it 1958,” Hanson said. “The dynamic

wells are expected to be drilled this year. That’s more than double than the 862 wells drilled in 2010. The footprint of those wells is obviously increasing, too. In 2010, some 90,000 tons of solid waste were disposed of at the three solid waste sites in the oil zone, compared to 4,000 tons a decade ago.
