2) Robert Smith is the current President and Director and has all authority granted to him as by the Article of Incorporation; and 3) Roger Wilson and Donald Kent are the two current directors of ROL, and they have all authority granted to them by Articles of Incorporation. ROL is represented by Chad
Morgan. Kim and Bobby Rutherford, Jr. are represented by Bobby Reed. It would appear that determining
who is President and/or Director is key to deciding who has the authority over several properties, including the church building at 1201 E. Commerce with over 5 acres of land; the River of Life Complex that houses River of Life Food Pantry, Global Hearts International, and Family Dollar store; and the parsonage in which the Rutherfords reside. Church documents filed in the
lawsuit state that the President of the Corporation shall serve in perpetuity or until such time as he resigns the office or dies. Another document reads
that the Pastor of River of Life Family Worship Center shall fill the position of President. The President shall have general oversight of operations of the Corporation and supervise all activities. Numerous individuals signed

notarized affidavits indicating that they were in attendance on Easter Sunday, April 24, 2011, when Rutherford stated that Smith was from that day forward the Senior Pastor of the church and would run the day to day operations. The affidavits further state that Rutherford told them he would be attending another church. In a letter to the ROF, penned
in August 2011, Rutherford contends he is still the President of the Corporation and that, as such, he was to come back on a regular basis to oversee and monitor the continued growth and development of the church. Rutherford asserts that the church has not grown nor continued to function in the manner verbally agreed upon (by Rutherford and Smith). Smith maintains that the church
has continued to grow to the extent that seats are being added to the sanctuary. Rutherford’s letter states that
it was agreed he would continue to receive his current salary, including insurance and housing allowance until the end of 2011 and reduced thereafter to include “a tithe, offerings, and first fruits” designated to his ministry expansion. The letter does not indicate if he was paid these benefits. However, Smith stated that
ROL continued to pay a salary, insurance, and payments on the parsonage. Further, Rutherford insists that

he would be allowed to teach classes and fill people in on his evangelistic work from time to time. Something, his letter states, he is not being allowed to do. With regard to elders and board
members, Rutherford declared that these were advisory positions with no authority to make decisions. Church documents at the courthouse reveal that board
members have all authority granted to them by Articles of Incorporation. The board of directors, it reads, is obligated to manage, govern, and control all the activities, operations, business, assets, and property of the Corporation, to effectively ensure that the purpose of the Corporation, as set forth in the Bylaws are met and observed. Asserting his position as
“President,” Rutherford has attempted to remove the board members from their appointments, as evidenced by his letter. Other actions Rutherford spelled
out are: All elders, pastors, and any other form of leadership at ROL, the Food Pantry, or Global Heart International, are removed from any titles held. Rutherford gave the current
leadership team 30 days (which has now passed) to purchase the building at 1201 E. Commerce, Fairfield and contents, except for a computer, for $350,000; or pay a weekly rental fee of $2,000. Conversely, they could vacate the property. Documents show that the church
building was gifted to River of Life Family Worship Center, Inc. by Cornerstone Baptist Church in March 2009; consideration given being “love and affection which grantor has toward grantee.” A Certificate of Resolution
indicates that a loan for $216,000 was taken out at Community National Bank and Trust to purchase the parsonage. Rutherford contends that the
down payment of $20,000 was made by him, and that the monthly payments were part of his income. It reads, “Resolved further, that
if and when Bobby Rutherford, Jr. is no longer the Minister of River of Life Family Worship Center, Inc. that Bobby Rutherford, Jr. may purchase the real property described in Exhibit A for the amount of the balance of the loan of said real property [parsonage].” Smith maintains that ROL has
made and continues to make the monthly payments. Rutherford declared in his letter
that he has been slandered. He told The “Times” several “Letters to the Editor” will be forthcoming on his behalf. Rutherford said he had challenged
the elders to take a lie detector test and reported that two said they would, but one refused. Both men contend that any
monetary value of the properties are to be used for the ministry and are not in any way for personal gain. Should members choose to
stay under the leadership of Robert Smith, whether at the current location or a new one, Rutherford insists that the group discontinue using the River of Life Family Worship Center name and obtain a new 501c3 with another identification. Rutherford contends that he “is
not mad,” and Smith states that he had considered Bobby to be his best friend. The court will now have to decide
who is in charge of the non-profit 501c3 church. Will it be the founder, Bobby Rutherford, Jr., or current Senior Pastor Robert Smith? The “Times” will inform our

will be having their 4th Annual Fall Festival on October 26th from 6:00 p.m. to 8:00 p.m. There will be games, candy, prizes, and loads of fun. River of Life Family Worship
Center is again providing a reality, 4-day event – Hell House At The Park, from October 28th to October 31st, beginning at 7:00 p.m. Each year, the plot of the play is different from the previous year. The cost is $10 per person, with group rates available. It will be on the Moody Reunion Fairgrounds in and around the flea market booths. Hell House is not recommended
for anyone under 13 years old, but there will be a kid carnival for the younger set, and a concession stand will be open. Teague Parkfest is set for
Saturday, October 29th in the Teague City Park from 10:00 a.m. until 4:00 p.m. Boo on the Square, Freestone County Courthouse Square that is, hosted by the City of Fairfield, is sure to delight kids of all ages. Have you seen the great decorations on the lawn? It all begins at 5:30 p.m. and ends at 7:00 p.m. on October 29th. The City is also providing
a “Spooktacular” move at the Moody Fairgrounds that evening starting at 8:00 p.m. - “The Ghost and Mr. Chicken,” starring Don Knotts. The movie is free; popcorn and cokes are $1.00 each. The movie is on the opposite side of the park from where Hell House is being presented. The “Times” continues our
tradition of taking pictures of your little goblins, princess, Ninja’s, and every other costumed trick- or-treater. This year, the event will be on Saturday, October 29th from 5:00 – 8:00 p.m. We will be featuring these photos in our November 1, 2011 edition. VFW Post #5872 in Fairfield
will have a Halloween Dance on October 29th at 8:00 p.m. The Gordon Collier Band will be featured. Trinity Star Arts Councils will present “All Hallowed” on Sunday, October 30th at 2:00 p.m. at the Historic Teague Hotel. Written by Bill C. Davis and directed by George D. Boyd, the feature is described as a comedy for mature audiences. Admission is free, but donations are accepted. Teague has set Trick or Treat for Monday, October 31st from 5:00 p.m. to 8:00 p.m. First United Methodist Church in

artist who has been painting since 1948. Mr. Vee has spent his life mastering the paintbrush. He has painted hundreds of pictures, including portraiture, Western scenery, musicians, U.S. Senators, Presidents and Heads- of-State. Mr. Vee’s artwork is grounded primarily in Realism. His paintings and commissions are managed by Healthy Rhythm Community Art Gallery. Mr. Vee’s 24” x 36” oil painting
of the great American Indian warrior Geronimo can be viewed at Healthy Rhythm Community Art Gallery Monday through Friday from 12 pm to 5 pm until October 30th.
