The application fee will be €36,000 per licence plus an annual fee in the region of €7,000 to €200,000 which will depend on the gross win (see chart below). Operators applying for licences for both online casinos and sports betting will have to pay an application fee of €51,000.
Meanwhile under the new legislation Danske Spil will still maintain its monopoly within the lottery, horse and greyhound racing market. The horse racing in particular has caused most contention although the government has justified this on the ground of protecting the profits of local horse tracks.
Organised racing has been happening in Denmark since 1820 and there are currently eight trotting tracks. These lanes attract between 350,000 and 400,000 spectators per year. Two of the major horse racing tracks are located in Copenhagen and are a huge tourist attraction.
Danske Spil has an agreement with ATG (Swedish provider of horse racing) so players have access also to Swedish racing. The government wants to keep the racing under the monopoly fearing if it was an open market more ‘professional’ players would be attracted to play on foreign racing games rather than the Danish horseracing and its revenue would be reduced.
A draft bill for the new online legislation was submitted to the European Commission in July last year. Initially although the draft text of the law was notified to the European Commission and made public the Danish government later invoked the confidentiality procedure. However the draft law was finally published on February 12 and was due to come into force on January 1 2011.

The gambling act includes the following provisions:
• Danske Spil will retain the monopoly on lottery, bingo, scratch cards, keno and horse racing and greyhound racing, for an indefinite period of time.
• Online gaming licences are issued for five years.
• There are two forms of gambling services for which licences will be offered – sports betting online and offline and online casino and poker. Casino games can offer blackjack, roulette, slots, baccarat, punto banco and poker.
• To play online betting and casinos games the player must be registered as a client by the licencee and provide various identification information
• Players cannot play more than DKK10,000 for a temporary account. Daily, weekly or monthly deposit limits can be set. A players request for an increased on fixed deposit may come into force after 24 hours.
• Permits for games providers can be given to Danish or foreign EU companies with a representative in Denmark.
• The Gaming Authority will ensure compliance with the law regarding regulations and licensing conditions and can revoke any licences.
• After one year a report must be issued outlining whether the licencee has offered its service in accordance with the authority’s conditions.
