Scott Hartinger, Esquire 301-698-8182 Motor Vehicle Accident

Te Honorable Mary Ann Stepler Frederick County

587-00235 James K. Sillers v. Washington Suburban Sanitary Commission

Timothy F. Maloney, Esquire 301-220-2200 Employment

Te Honorable Tomas P. Smith Prince George’s County

In this motor vehicle accident case the question on appeal is whether the $70,000.00 award for past loss wages was based on impermissibly speculative evidence. Resolution of this issue turns on the specific facts of the case, including that the plaintiff allegedly did not have either written records or an excellent recollection of dates and times of employment but instead provided tax returns together with her attempts at recollection to support her prior loss wage claim. Te case turns on the level of precision necessary to prove prior lost wages.

Te question on appeal is whether Article 49B, Section 42, authorizing a private cause of action for claims of discrimination, applies to the Washington Suburban Sanitary Commission.
