In just about every corporate and public disaster within my memory, the sequence of events or one closely resembling are repeated in nearly every major and minor disaster and catastrophic situation. This is the pattern of management in crisis. Eventually, as gaff, bad decisions, willful delay, and economic and asset protection decisions dominate over victim management decisions gets exposed, events begin dragging management in the direction they should have been going from the start.

While she was on the medical leave the Company and the Union conducted an investigation. The investigation concluded that her sexual harassment claim was not credible. However, during the course of the investigation the Company learned that the plaintiff had stated to a coworker that she had threatened to shoot a fellow coworker. Under the Company’s “zero tolerance” policy on workplace violence the Company decided to terminate the employee after her medical leave ended.
After learning of her termination, the employee filed a grievance. The Union settled the grievance with her employer. The settlement would have allowed her to return to work on a “last chance” basis. The employee rejected this settlement and filed a lawsuit.
