Addressing The Risks of Contingent Labor
Due to recession-driven cost-cutting, the need to quickly expand and contract staff, many organizations have increased the utilization of temporary and
contract professionals. The contingent labor force in the U. S. has grown by more than 300,000 workers since July 2009, making it a prominent segment of today’s total workforce. In addition to representing an increasing percentage of the workforce, contingent workers today often fill key positions in such functions as finance, IT, operations, sales and marketing. With the increased influence and prominent role of contingent labor today, related security and workplace safety concerns must be addressed to reduce the exposure to legal liability and promote safety and security.
Case in point: In 2009 in Los Angeles, it was discovered that a convicted sex offender was employed as a temporary employee at a health clinic for a lengthy time period. When the clinic uncovered the criminal history of this temporary employee, they realized that no process was in place to determine how many of their 2,000-plus temporary employees had undergone criminal background checks. As a result, the clinic suspended the contract it had with its largest provider of temporary employees. In 2003 in New Jersey, a woman was stabbed to death by a home health care worker and it was discovered that the employee had previously been fired for misconduct by another agency. A jury awarded the victim’s family $40 million.
