What do I do if the house I am buying is affected by possible Chancel Repair liability?
Nigel Morgan, Senior Partner at MLM Cartwright solicitors says... Your solicitor will carry out
a search against the property you intend to purchase to determine if there is any chancel repair liability. Chancel repair liability can only affect land within a Church of England Parish which has a Vicar (not a Rector) and has a church dating from the medieval period or earlier. It is a possible liability to contribute towards the cost of repairs to the church. In the recent case of Aston Cantlow v Wallbank judgement was given against the owner of the property affected by the Chancel repair liability in the sum of £256,000 with around £250,000 in legal costs. If your solicitor's search reveals a potential liability he will be able to arrange a single premium insurance policy to cover any liability.

A Char tered Surveyor will be able to assist you and will be able to under take a survey of the proper ty and diagnose the course of the movement. Only then can the problem be rectified. There are many methods available to underpin the building. Specialist firms will be instructed by your surveyor to provide quotations for the chosen method, and it is impor tant that this work is carried out in accordance with the agreed schedule. Unfor tunately, underpinning is expensive - there may be a case for claiming off your building insurance and again your surveyor can assist you with this.
