Gaining Ground in the Federal Procurement Marketplace

The number of women-owned small businesses (WOSBs) has increased substantially over the past thirty years. Many are successful in a range of industries with major impacts on regional economic growth.

Unfortunately, this same level of success has not


been achieved in the federal procurement market- place. The proportion of federal dollars awarded to WOSBs remains low – peaking around 3.4 percent. In addressing this issue, a recent SBA proposed


rule, Women-Owned Small Business Federal Contract Program (Federal Register, 75(42), 2010) would require federal agencies to utilize 83 NAICS (North American Industry Classification System) codes in determining contract set asides for WOSBs. These codes reflect industries in which WOSBs are found to be under- represented or substantially under-represented in the federal procurement marketplace. Some key components of the proposed rule:


• Authorization for WOSB contract set-aside when anticipated contract price is less than $5 million for manufacturing contracts and less than $3 million for other contracts.

• Removes requirement that a federal agency certify it engaged in discrimination against WOSBs to join the program.


• Allows WOSBs to self-certify or be certified by a third-party.


• Requires self-certifying WOSBs to submit robust certification to the SBA and at the federal Online Representations and Certifications Application site. Federal agency contracting officers have full access to this repository.
