earth to be buried in a christian like and decent manner at the discretion of my executors nothing doubting but at the general resurection I shall receive the same again by the mighty power of God; and as touching such worldly estate where with it hath pleased God to bless me within this life; I give and dispose of the same in manner and form following that is to say after all my just debts and funeral expenses are truly and faithfully paid I give and bequeath to my son Jesse Spurgeon all that tract or parcel of land whereon I now live to the only proper use and behoof [sic] of him and his heirs forever except that he is to furnish his mother my dearly beloved wife with a comfortable and sufficient living during the time she remains a widow and keep her two milch cows and a creature to ride when she reasonably require it and also pay or cause to be paid 200 dollars towards paying for the land where Jonathan my son lives on; and likewise find my two youngest daughters sufficient maintenance until they arrive at the age of 18 accept other wise provided for and I also give and bequeath to my son Jonathan Spurgeon all that tract or parcel of land whereon he now lives to and for the only proper use and behoof of him and his heirs forever with his paying 200 dollars towards paying the purchase of same; and I also give and bequeath to my daughter Dusilla [Drusilla] wife of Amos Glover to be paid to her or her heirs out of my personal property within two years after my decease the sum of 20 dollars and further my will and desire is that all the remaining part of my moveable propperty be sold and equally divided between my other 4 daughters namely Lenny wife of Jeremiah Castilla [Casteel] Catharine wife of Jonathan Kelly, Kiza and Betsy - and I also constitute and ordain my beloved sons Jesse and Jonathan Spurgeon. sole executors of this my last will and testament ....240


His will was probated in July of that year and his son Jesse, executor, was bonded in the sum of $2000 on 9 July 1810.241 James’ wife Elizabeth is shown being a purchaser at the estate sale.242


She is shown listed as widow Spurgeon in the 1812 Tithable Tax List for the (West)


Virginia Personal Property Tax with one horse (mare, colt, or mule); as well, her sons John, Jessee, and Jonathan are listed near her, Jonathan noted with one white person above 16 and 4 horses (mare, colt, or mule).243


Elizabeth is also listed in the Tithable Tax List for 1813 as widow Spurgeon with one horse.244 Among some of the things inventoried of James Spurgeon’s estate


were the following unusually named items: “... one dung shovel, a pair of Steelyards, 8 1/2 pounds of beeswax, a pair of horse geers, a shovel plow, a Clevis & swingle tree, a Spider, two Riddles, and a Check Reel; also included were Windsor chairs, hogs, cows, colts, calves, old bells, plows and yokes, furniture, notes due and book accounts against debts, and crocks, barrels, and tubs, among many other mentioned items.”245


Listed on the estate auction as buyers were his sons Jesse, Jonathan, and sons-in-laws John Kelly, Amos Glover, Jeremiah Castile (sic), and
