Ageism at Work


Age discrimination at work is the most commonly reported discrimination in the UK and affects both young and old.


SURVEYS before last year’s new legislation came in suggested ageism was rife in the workplace, with both younger and older employees bearing the brunt.


One report from the Chartered Institute of Personnel and Development (CIPD) said workers had a tiny five-year window of opportunity between 35 and 40 when you were considered neither too junior nor too senior for a job.


The report said one in 12 workers under 35 had been told they were too young and a far larger proportion of over 40s had been told they were too old.


One in five workers had been discouraged from applying for a job because of an age restriction, according to the Institute.


Another study from the TUC found businesses refused to hire older workers or pay to retrain middle-aged staff, leading the organisation to claim there were more than a million jobhunters in their 50s and 60s on the dole because firms considered them too old.


Law firm Eversheds found in its research young people were more likely to suffer age discrimination than older people.


It said 58 per cent of employees aged between 16 and 24 felt they had been discriminated against because of their age compared with 48 per cent of people aged


over 45.


British Airways found itself in hot water with disgruntled former pilots and cabin crew who took the airline to a tribunal.


They were angry about a policy forcing them to retire at 55 even though ground staff could go on until they were 60.


Five test cases went before a tribunal as part of a campaign by 68 former employees who called themselves Option 55 - but they were unsuccessful.

• No one should feel a victim of their age in the workplace. Unfortunately, many young people are still treated unfairly simply


because of their age.


• You now have the right to take legal action if your boss or colleagues have used your age as the reason to treat you unfairly.


• You cannot be refused a new job simply for being too young.


• A job ad cannot ask for a


certain number of years experience.


• You cannot be denied promotion or training because you are too young.


• Your employer cannot give you worse pay or benefits simply because of your age.


• You cannot be dismissed on grounds of age.
