MORE ABOUT QUALIFYING FOR BANKRUPTCY
Last week we talked in general about qualifying for Chapter 7. I ended the article by talking about people whose income is more than the median income. There are many factors that go into calculating median income:
Household Size: I mentioned previously that median income is based on household size. When BAPCPA (the new bank- ruptcy law) became the law in 2005, everyone (including the bankruptcy judges) wanted to know how to calculate house- hold size. Do you just count up everyone in the household? What about a roommate who rents space from you? What if your elderly mother-in-law lives with you; does she (and her income) count? Eventually, after much debate, the Courts have decided that household members do not include persons who live with you if they are not your dependents. However, if they contribute money to the household-whether in the form of rent or contri- bution to household expenses (such as paying the cable bill or buying groceries), then that contribution is considered income to you.
Once we have determined household size, we move onto calculating median income. Median Income: There are exceptions to the median income rules: • A disabled veteran does not need to qualify for Chapter 7 through the income rules
• Social security income-retirement and disability-isn’t counted when looking at median income • Alimony and child support are counted as income received; but if a non-filing spouse pays child support, or does not use all of his/her income for the household expenses, then the filing spouse may be able to deduct that amount from income. Generally, with the above exceptions, all income is included in the calculation: wages, net profit from a business, rental income, interest, retirement and pension income (unless it is Social Security retirement), private disability payments, and unemployment are the most common forms of income. What time period does the Court look at for the income calculation? Your income is based upon the last 6 calendar months before you file. So, if you plan to file June 1, 2009, your income from December 1, 2008 to May 31 2009 is used to calculate your income for the “Means Test”.

Brian Morgan to Play for the Black Bears

Windham resident Brian Morgan has accepted a full four-year scholarship to play hockey for the University of Maine Black Bears beginning in the fall of 2012. For the past two years, Morgan has commuted three hours daily to pursue his hockey dreams. He has attended Xavarian Brothers High School in Westwood, MA, for the past two years, and is finishing up his sophomore year. Morgan made the commute so that he could play hockey for the Boston Junior Bruins, which play in Marlboro MA. His daily commute begins at 5:30 a.m., and often, he does not get home until 11 p.m., logging more than three hours a day in the car. Next season, the five-foot, eleven-inch, 180-pound Junior Bruins forward, who was the third leading scorer in the Empire League this season with a 30-40-70 line in 39 games, will return to Windham High School as a junior and he will play for Sean Trembley and the New Hampshire Junior Monarchs this fall in the Eastern Junior A Hockey League in Hooksett. After visiting eight universities in the spring, Morgan narrowed his choices down to three, ultimately choosing the University of Maine.
Kathryn (Kulas) Viens
Obituaries
Kathryn (Kulas) Viens, 72, of Pelham, died May 28, 2010, in The Courville at Nashua. She was born December 24, 1937, in Nashua, daughter of the late Harry and Helen (Hennessey) Kulas. Kathryn was the wife of Antoine “Tony” Viens of Pelham. Kathryn loved spending time with her family and enjoyed reading.
Besides her loving husband Tony, survivors include two sons and
two daughters-in-law, Paul and Shan Kerouac of Seattle, WA, and Brian and Tracy Kerouac of Tennessee; two daughters and a son- in-law, Marta and Charlie Langlais of Nashua, and Holly Kerouac and her significant other Craig Hall of Bridgewater; two stepsons, Donald Viens and his wife Lisa of Boothbay Harbor, ME, and Denis
Viens of Londonderry; a brother and a sister-in-law, Robert and Patty Kulas of Nashua; two sisters and two brothers-in-law, Patricia and Neil Clark of Nashua, and Mona and Albert “Chuck” Nita of Wilton; eight grandchildren, two great-grandchildren, and several nieces, nephews, and cousins.
All services were held earlier in the week. In lieu of flowers the family encourages donations be made in Kathryn’s loving memory to the Alzheimer’s Association, Greater NH Chapter, One Bedford Farms Drive, Bedford, NH 03110. The Dumont-Sullivan Funeral Home in Hudson was in charge

Herman L. Hanson
Herman L. Hanson, 75, a well-
known Pelham resident, and a loyal and respected member of the New Hampshire and Massachusetts veteran’s community, died May 26, 2010, at Southern New Hampshire Medical Center in Nashua. He was the beloved husband of Shirley M. (Butterfield) Hanson with whom he celebrated their 50th wedding anniversary on November 29, 2009.
Born in North Billerica, MA, March 14, 1935, the son of the late Bertil L. and the late Carrie (Nielson) Hanson,
he attended Billerica schools and was a graduate of Howe High School. A veteran of the Korean War, he served from 1953 to 1957 in the
Air Force as a Staff Sergeant. After his military service, Herm worked as an elevator constructor
for Payne Elevator for over 33 years as a member of Local 4 in Boston, MA. Active in veteran’s affairs, he was a Past Commander and
current Adjutant of the Pelham Post 100 American Legion and former District Commander of District 4 American Legion of New Hampshire.

In addition, he was a member of the VFW of Pelham Post 10722,
the Korean War Veterans of Lowell, MA, and participated in various Korean War veteran activities at Hanscom Air Force Base in Bedford, MA. Herm was also a proud member of both the American Legion
Post 100 and the Hudson American Legion Honor Guards for many years where he performed the presentation of Colors and funeral honor guard ceremonies for hundreds of U.S. war veterans. A member of the Pelham Senior Citizens, he also played Santa Claus with the American Legion for Special Needs Children and the Pelham Good Neighbor Fund. Well liked by many in Pelham, Herm was always doing something for someone else and gave of his time freely. He will be deeply missed by those who knew him well. Herm was a member of the First Congregational Church of
Pelham and was a former member of St. Anne’s Episcopal Church in North Billerica.
Besides his wife, Herm is survived by three sons, Paul Hanson and his wife Sue of Merrimack, Kenneth Hanson of Manchester, and David Hanson and his fiancé Nancy Bartlett of Amherst; his daughter, Karen Wrigley and her husband Roger of Phillipston, MA; a daughter-in-law, Lisa Hanson of Pelham; four grandchildren, Carrie and Cayla Hanson of Pelham, and Sarah and Heather Wrigley of Phillipston; a brother, Herbert Hanson of Port Charlotte, FL; a sister-in-law Marcia Hanson of Dummer; several nieces, nephews and cousins. He was also the father of the late Robert C. Hanson and brother of the late Leonard Hanson. His funeral service was held June 2 at the First Congregational
Church of Pelham. Burial was in Gibson Cemetery, Pelham. Those wishing may make contributions in his memory to the
Juvenile Diabetes Research Foundation of North Central CT and Western MA Chapter, 20 Batterson Park Road, Third floor, Farmington, CT 06032, or to the American Legion Post 100, Windham Road, Pelham, NH 03076.
