EVEN MORE ABOUT WHAT IS BANKRUPTCY
There are many misconceptions about what bankruptcy is,
who qualifies to file bankruptcy, and what effect is has upon your future credit and employment. If you were to read the actual bankruptcy laws, you would find that Chapter 7 bankruptcy, which is the most common form filed by both individuals and businesses, is called a “liquida- tion”. You would expect a business filing Chapter 7 to liquidate by selling off its inventory and other assets, and then close the doors forever. However, for individuals, a Chapter 7 “liquida- tion” is very different. First, in a Chapter 7, individuals are allowed to keep their property, within certain limits called “exemptions”. For example, in New Hampshire each individual homeowner is entitled to a property exemption of $100,000, regardless of whether or not a bankruptcy is involved. What does this exemption mean? Someone who owns a single family home worth $300,000, and owes a mortgage of $200,000 has $100,000 worth of equity in the home. In that example, if the homeowner resides on the property and files Chapter 7, he or she could use the state’s $100,000 exemption to keep the home. Of course, this assumes that the homeowner can afford the payments! There are many other exemptions available, such as automo- bile, household furniture exemptions, and a “wildcard” exemp- tion. In New Hampshire, the “wildcard” exemption allows a bankruptcy filer to keep a maximum of $8,000.00 in any property. Some exemptions, such as the ones for domestic fowl, and a church pew are outdated, but remain on the law books. In the next article, we’ll talk about Chapter 13, a way to restructure your debts.
