small disputes. Those who have heard Ms. Keller speak, appreciate the power- ful way she combines wit and logic to demand a favorable outcome for her clients. Ms. Keller has earned numerous accolades (including a Top Gun Trial Lawyer Award for Business Litigation) stemming from verdicts in prominent cases, such as the Barbie versus Bratz litigation and special-circumstance murder cases. Chris Purcell – the 2011 recipient

of the Top Gun Trial Lawyer Award for Personal Injury – will likewise convey his winning techniques and cogent point- ers, demonstrating approaches to argu- ment adaptable to a variety of cases. Purcell will join in teaching techniques such as how to “put a price on pain,” incorporate jury instructions and verdict

forms into closing argument, set the stage for rebuttal, and address flaws in one’s own case. The Honorable Franz Miller, Judge

of the Orange County Superior Court, will bring a unique perspective to the subject, not only from his tenure as a trial judge, but from his background as a sen- ior staff attorney for the Court of Appeal, private practitioner, and deputy public defender. Judge Miller’s insights are sure to enlighten the discussion, including the importance of developing and reinforc- ing a theme for each case, and how (or how not) to argue credibility. As consumer attorneys, we fre-

quently face daunting challenges – from bearing the initial burden of proof, to confronting well-financed opponents who reflexively gainsay our every

assertion in hopes of gaining unwarrant- ed concessions. Demonstrating tech- niques that potentiate our power of per- suasion is one of many ways the Orange County Trial Lawyers Association helps enhance the quality of practice and results for its members and their clients. As barrister Horace Rumpole (another quintessentially British character) might have said: With that proposition, My Learned Friends, there can be no room for argument.
