PROPER ID REQUIRED FOR Real Estate License Renewal
I WANT TO ALERT YOU TO THE EFFECT OF THE GEORGIA ILLEGAL IMMIGRATION LAW PASSED IN 2011 ON LICENSING REQUIREMENTS FOR REAL ESTATE LICENSEES AND APPRAISERS. I AM ALSO INCLUDING SOME INFORMATION THAT YOU MAY FIND HELPFUL ADDRESSING WHETHER OR NOT A CREDIT UNION CAN HOLD REAL ESTATE TRUST AND ESCROW CHECKING ACCOUNTS IN GEORGIA.


1) IMPORTANT NOTICE TO REAL ESTATE LICENSEES, APPRAISERS, APPRAISAL MANAGEMENT COMPANIES, INSTRUCTORS AND SCHOOL DIRECTORS


Effective January 1, 2012, the Georgia “Illegal Immigration Reform and Enforcement Act of 2011” requires all applicants for real estate licensure or appraiser classification, and those applying for renewal of an existing license or classification (including a broker or qualifying broker seeking to renew a real estate firm license or applying for a new firm license), Appraisal Management Companies, Instructors, and School Directors to submit to the Georgia Real Estate Commission (GREC) (1) a “secure and verifiable document” for identification purposes as defined in O.C.G.A. §50-36-2 and (2) a “signed and sworn affidavit verifying the applicant’s lawful presence in the United States” as required in O.C.G.A. §50- 36-1 (hereinafter, the additional “Documents.”) If your license or classification is currently eligible for renewal, you may renew it prior to December 31, 2011, without having to provide the additional documents at that time. After January 1, 2012, you must provide the additional documents to the GREC prior to renewing online or you may attach them to your paper renewal application. You must provide the additional documents for every license or classification renewal. If you typically renew online, please allow five business days from the submission of the additional documents for the GREC to notate your license record so that you will be able to renew online. The additional documents may be submitted to the GREC either in person, via fax, via e-mail, via courier, or via U.S. mail. The documents must be legible. If the GREC does not receive the legible additional documents by your license or classification renewal due date, the license or classification cannot be renewed and will lapse. The burden is on you to submit the additional documents as required. Please be aware that if the GREC does not receive the additional documents by the license or classification renewal due date, the license or classification cannot be renewed. The license or classification will then lapse and you must stop all real estate or appraisal activity. You will be required to submit the documents and then pay a minimum reinstatement fee of $100.00 to reinstate your license or classification.
